Welcome to Tils tiny Terrors! The terms “I”, “me” and “my” refer to Tils tiny Terrors. Tils tiny Terrors operates this shop and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a personalised shopping experience (the “Services”). This shop is powered by Shopify, which enables me to provide the Services.

These terms and conditions, together with the policies referenced herein (these “Terms” or “Agreement”), describe your rights and obligations when you use the Services.

Please read these Terms carefully because they contain important information about your legal rights and remedies, including disclaimers of warranties and limitations of liability.

By visiting, interacting with, or using my Services you confirm that you accept these Terms and my Privacy Notice. If you do not agree to these Terms or the Privacy Notice, you must not access or use the Services.

By agreeing to these Terms you represent that you are of legal age in the state or region where you reside and that you have permitted any minor in your care to use the Services on devices that you own, have purchased, or manage.
To use the Services — including accessing or navigating my online shops or purchasing products or services I offer — you may be required to provide certain information such as your email address and billing, payment and shipping information. You represent and warrant that all information you supply to my shops is true, accurate and complete, and that you are fully authorised to provide such information.
You are solely responsible for the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 – MY PRODUCTS
I have made every reasonable effort to display the colours and images of my products that appear in the shops as accurately as possible. However, the actual colours you see will depend on your device and its display settings.
I do not warrant that the appearance or quality of products purchased will meet your expectations or exactly match images on the site.
All product descriptions are subject to change at my discretion without prior notice. I reserve the right to discontinue products at any time and to limit the quantities offered to any person, geographic region or jurisdiction.

SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. I reserve the right to accept or decline your order at my discretion for any reason. Your order is only accepted once I send a confirmation that the order has been accepted and processed. Acceptance of your order is conditional on receipt and successful processing of payment. Please review your order carefully before submitting it, as I may be unable to cancel or change an order after acceptance. If I cannot accept, change or must cancel an order, I will attempt to notify you at the email address, billing address and/or telephone number provided with the order.
Returns and exchanges are handled in accordance with my Returns Policy [LINK].
You represent that purchases are for your personal or household use and not for commercial resale or export.

SECTION 4 – PRICING & BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time of order and will be shown in your order confirmation email. Unless stated otherwise, prices do not include taxes, shipping, handling, customs duties or import fees.
Prices on my online shops may differ from prices in physical stores or other online shops operated by third parties. Promotional offers may be subject to separate terms. If there is any conflict between a promotion’s terms and these Terms, the promotion terms will govern for that promotion.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases you make. You agree to promptly update your account and other information, including email address and payment details, so I can complete your transactions and contact you if necessary. You represent and warrant that (i) any credit card information you supply is true, correct and complete, (ii) you are authorised to use the payment method you provide, (iii) charges incurred by you will be honoured by your card issuer, and (iv) you will pay the charges at the prices then in effect, including shipping and applicable taxes.

SECTION 5 – SHIPPING & DELIVERY
I am not responsible for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. I am not liable for delays caused by carriers, customs processes or events outside my control. Title and risk of loss for items pass to you when I deliver the items to the carrier for shipment.

SECTION 6 – INTELLECTUAL PROPERTY
The Services, including but not limited to trademarks, logos, text, images, graphics, product descriptions, video and audio files and their selection and arrangement, are owned by Tils tiny Terrors, its affiliates or licensors and are protected by copyright, trademark and other intellectual property laws.
These Terms grant you a limited right to use the Services for personal, non-commercial purposes only. Except as expressly authorised by me in writing, you may not reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store or transmit any of the material on the Services. No provision of these Terms grants you any licence or other right to any patent, trademark, copyright or other intellectual property of Tils tiny Terrors, Shopify or any third party. Unauthorized use of the Services may violate intellectual property laws. All rights not expressly granted are reserved.
The names, logos, product and service names, designs and slogans of Tils tiny Terrors are my trademarks or those of my affiliates or licensors. You may not use such marks without my prior written permission. Shopify’s names and logos are trademarks of Shopify. All other marks are the property of their respective owners.

SECTION 7 – OPTIONAL TOOLS
You may be offered access to third-party tools as part of the Services that I neither monitor nor control. Your use of such tools is at your own risk. I provide access to these tools “as is” and “as available” without any warranty, and I disclaim liability arising from your use of those tools. It is your responsibility to review and accept the terms and conditions provided by the third-party provider. I may add new features or tools as part of the Services; those features will also be governed by these Terms.

The Services may include links to third-party websites and resources. I am not responsible for the content or practices of third-party sites. If you follow links to third-party sites, you do so at your own risk. I am not liable for any loss or damage arising from your use of third-party sites, products or services. SECTION 9 – RELATIONSHIP WITH SHOPIFY
Tils tiny Terrors is powered by Shopify, which enables me to provide the Services. All sales that you make in my shop are made directly with Tils tiny Terrors. By using the Services you acknowledge and agree that Shopify is not responsible for transactions between you and Tils tiny Terrors, including any product liability, damages or losses. You release Shopify and its affiliates from liability arising from your purchases and transactions with Tils tiny Terrors.

SECTION 10 – PRIVACY POLICY
All personal data collected through the Services is subject to my Privacy Policy, which is available here [LINK]. Certain personal data may also be subject to Shopify’s Privacy Policy. Because the Services are hosted on Shopify, Shopify collects and processes data about your access to and use of the Services to provide and improve the Services. Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, shipping charges, delivery times and availability. I reserve the right to correct errors, update information, change or update content and cancel orders if any information on the Services is inaccurate, without prior notice (including after you have submitted your order).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TILS TINY TERRORS, MY AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS AND SHOPIFY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF REVENUE, LOSS OF SAVINGS, LOSS OF DATA OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR ANY PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.

You agree to indemnify, defend and hold harmless Tils tiny Terrors, Shopify and my affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities, claims or expenses (including reasonable attorneys’ fees) arising out of (1) your breach of these Terms or the documents they reference, (2) your violation of any law or the rights of a third party, or (3) your access to or use of the Services. I will notify you of indemnifiable claims, provided that failure to notify will not relieve you of your obligations unless the delay materially prejudices your ability to defend the claim. I may assume control of the defence and settlement of a claim at my expense; you may not settle a claim that admits liability or requires obligations without my consent (not to be unreasonably withheld). You will cooperate in the defence as reasonably requested.

If any provision of these Terms is held to be illegal, invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remainder of the Terms will remain in full force and effect.

My failure to enforce a right or provision in these Terms will not constitute a waiver of such right or provision. These Terms and any policies posted on the Services constitute the entire agreement between you and Tils tiny Terrors regarding your use of the Services and supersede prior agreements or communications.

You may not assign or transfer these Terms or your rights or obligations without my prior written consent; any attempted assignment will be void. I may assign, transfer or delegate these Terms and my rights or obligations without consent.

These Terms and any separate agreements whereby I provide you Services are governed by the laws of the country or state where Tils tiny Terrors is headquartered, and you agree to submit to the jurisdiction of those courts.
